Temporary Fence Permits in Houston & Fort Bend
Private property fencing = no permit. Right-of-way or sidewalk = you need one. Here's how to tell which you're dealing with and how to pull a permit fast.
The fence permit line
On your project's property: no permit. Driveway, parking lot, yard — you can set panels without the city or county getting involved.
In the public right-of-way (ROW): permit required. That's anything in the street, on a sidewalk, or encroaching past your property line into the public strip.
On a utility easement: check before placing. Most residential utility easements allow temporary construction fencing; some commercial easements don't.
City of Houston
The permit is pulled through Houston Public Works — Right of Way Division. Application is online, fee is typically $40–80 depending on run length and duration. Standard turnaround is 24–72 hours.
You'll need:
- Site plan showing the fence run, marked against the property line and sidewalk
- Proof of General Liability insurance ($1M minimum, $2M preferred)
- Contractor info — if your GC or subcontractor is installing, their info goes on the permit
Fort Bend County
Fort Bend uses the County Engineer's office. ROW permits are handled at the county level for unincorporated roads, and at city level (Katy, Sugar Land, Richmond, Stafford, Missouri City) for incorporated streets. Fees run similar to Houston ($40–100).
Specific city offices:

The one thing people miss
If your fence encroaches even a foot into the sidewalk, it triggers the ROW permit. Measure twice. We install plenty of fences where the panels sit right at the sidewalk edge on private property — the rails go up vertical to avoid any overhang.
Lead time
Don't plan a Monday install if you're filing the permit Friday afternoon. Houston ROW runs business hours — submit by Tuesday for a Friday install. Fort Bend is usually faster outside of Houston but still plan for 48 hours.
